Jones & Wagener (Pty) Ltd Engineering and Environmental Consultants (J&W) was appointed by Lonmin PLC to undertake a Waste Management Licence Application (WMLA) for the proposed decommissioning and replacement of the general waste incinerator with a hazardous waste incinerator and associated infrastructure for the Lonmin Western Platinum Precious Metal Refinery in Brakpan.

The Draft Environmental Impact Assessment Report (EIR), Environmental Management Programme (EMPr) and the Waste Management Licence Report was made available for public review and comment from 15 May - 26 June 2015. The reports were also submitted to the relevant authorities for review and comment. A public meeting was held on 11 June 2015 at the Springs Civic Centre, to discuss the contents of the draft reports and also to obtain comments from all I&APs.

Please take note that in light of the recent amendment of the waste management activities in terms of the National Environmental Management Waste Act 59 of 2008 (NEM:WA), the required report for the activities triggered by the proposed project changed to require a Basic Assessment process to be undertaken and not a Scoping and Environmental Impact Report (S&EIR) process. Therefore, a Final Basic Assessment Report (BAR) with a Waste Management Licence (WML) and the Environmental Management Programme (EMPr) will be made available for public review and comment from 6 April to 15 May 2017.  Please note that the content, specialist studies, impact assessment and findings have not changed, only the report format. According to the National Environmental Management Act, Sub-regulation 56 (6) comments on the Final BAR/WML/EMPr must be addressed to the competent authority, the Department of Environmental Affairs (DEA). The public participation office would also appreciate it if you could send us a copy of your comments. The way forward

The following are the next steps in the Basic Assessment process:

  • The DEA and the commenting authorities will review the Final BAR/WML/EMPr;
  • Based on their findings, the DEA will grant or refuse authorisation – a decision stating that the project may go ahead as planned or a decision stating that the project may not continue. For either of the decisions, the DEA will provide reasons;
  • Jones & Wagener will notify all I&APs about the DEA’s decision as well as the details of the appeal process. Any party may appeal the decision that was taken by the DEA.
