Komati Power Station – closure of Asbestos Disposal Facility

WASTE MANAGEMENT LICENCE FOR THE PROPOSED CLOSURE OF THE ASBESTOS DISPOSAL FACILITY AT THE KOMATI POWER STATION OUTSIDE OF MIDDELBURG ON THE R35 ROAD, MPUMALANGA, ON BEHALF OF ESKOM

Jones & Wagener (Pty) Ltd Engineering and Environmental Consultants (J&W) would like to inform you that Komati Power Station has been granted a Waste Management Licence (WML) for the proposed closure of the Asbestos Disposal Facility that is situated within Ash Dam 1 at the ash disposal complex at Eskom’s Komati Power Station. The asbestos site was used once for the disposal of asbestos and asbestos containing waste in 2008. In accordance with the site’s permit conditions, a 1 metre (m) thick layer of ash was placed over the asbestos, the site was fenced off and demarcated. Subsequently, the site has been ashed over twice and re-fenced with the correct demarcation. All asbestos waste is now removed off-site by a licenced operator to an approved asbestos disposal facility.

 The WML was granted by the Department of Environmental Affairs (DEA) on 1 February 2018, in terms of the National Environmental Management: Waste Act, 2008 (Act 59 of 2008) as amended.

 As required, all registered Interested and Affected Parties (I&APs) must be notified of the decision within 14 days of the date of the authorisation being received. As per the WML, we would like to draw your attention to Chapter 2 of Government Notice Regulation 993 (National Appeal Regulations, 2014 as amended) which prescribe the appeal procedure to be followed.

 An appellant must submit an appeal in the form of the Appeal Questionnaire and Appeal and Response Form, to the appeal administrator, and a copy of the appeal to the applicant, any registered I&AP and any organ of state with interest in the matter within 20 days from the date that the notification of the decision for an application for an environmental authorisation was sent to the registered I&APs by the applicant.

 Appeals must be submitted in writing in the form of the appeal questionnaire to Mr Z Hassam, Director: Appeals and Legal Review, DEA by means of one of the following methods:
