Jones & Wagener (Pty) Ltd Engineering and Environmental Consultants (J&W) hereby inform you that Lonmin Western Platinum Limited has been granted a Waste Management Licence (WML) for the decommissioning of a defunct general waste incinerator at Lonmin Western Platinum Precious Metal Refinery in Brakpan.

The WML was granted by the Department of Environmental Affairs (DEA) on 27 November 2018 (received on the 3rd of December 2018), in terms of the National Environmental Management: Waste Act (Act 59 of 2008) (NEM:WA), as amended in respect of Government Notice R921 of 29 November 2013, as amended.

As required by Regulation 4(2) of the NEMA Environmental Impact Assessment Regulations (Government Notice R982 of 4 December 2014, as amended) (NEMA EIA Regulations), all registered Interested and Affected Parties (I&APs) must be notified of the decision within 20 days of the date of the decision on the WML. As per the WML, we would like to draw your attention to Chapter 2 of the NEMA National Appeal Regulations (Government Notice R993 of 8 December 2014, as amended) (NEMA Appeal Regulations) which prescribe the appeal procedure to be followed.

Please note that the reasons for granting the licence are included in the WML, as issued by the DEA on 27 November 2018. A copy of the WML is available on the J&W website (www.jaws.co.za) and attached to this letter as Appendix A.

Should any party wish to appeal any aspect of the decision, an appeal must be submitted to the Minister of the DEA within 20 days from the date of this notification.

The appeal submission must be submitted in writing in the form obtainable from the Department of Environmental Affairs (DEA), also attached as Appendix B to this letter, and be accompanied by:

•           A statement setting out the grounds of appeal;

•           Supporting documentation which is referred to in the appeal submission; and

•           A statement, including supporting documentation, by the appellant to confirm compliance with Regulation 4(1) of the NEMA Appeal Regulations.
