KiPower Pipeline - Environmental Authorisation

ENVIRONMENTAL AUTHORISATION AND AMENDMENT: THE CONSTRUCTION OF PIPELINES AND PUMP STATIONS TO SUPPLY WATER TO THE PROPOSED KIPOWER INDEPENDENT POWER PRODUCER (IPP) AND EXISTING DELMAS COAL MINE NEAR DELMAS, WITHIN THE VICTOR KHANYE LOCAL MUNICIPALITY IN THE MPUMALANGA PROVINCE

On 10 October 2014, the Department of Environmental Affairs (DEA) granted KiPower (Pty) Ltd an Environmental Authorisation (EA) for the above project in terms of the National Environmental Management Act (Act 107 of 1998) (“NEMA”) and Environmental Impact Assessment Amendment Regulations (2010) (“NEMA EIA Regulations”). On 14 October 2014, the Environmental Assessment Practitioner (EAP) managing the application submitted a letter to the DEA requesting the Department to rectify errors made during the issuing of the Environmental Authorisation. Based on a review of the reasons for requesting an amendment to the Environmental Authorisation and in terms of regulation Environmental Impact Assessment Amendment Regulations (2010), on 24 November 2014, the Department made four (4) amendments on the original Environmental Authorisation.

 

All Interested and Affected Parties (I&APs) are herewith advised that in terms of Chapter 7 of the EIA Amendment Regulations (2010), anyone wishing to appeal the decision or any aspect of the decision to amend the Environmental Authorisation may do so in writing, stating the grounds of appeal, providing documentation which is referred to in the appeal and a statement that the appellant has complied with Regulation 62(2) or (3) together with copies of the notices referred to in Regulation 62.

 

A Notice of Intention to Appeal must be submitted to the Minister within 20 calendar days of the date of the decision (thus on or before 14 December 2014). A prescribed  Notice of Intention to Appeal and the actual Appeal Form, as well as assistance regarding the appeal process, is obtainable from the Appeals Directorate (Mr Z.
