Era Stene (Pty) Ltd (Era Stene) proposes to expand their existing southern clay quarry onto the remaining extent of portion 7 of the farm Rietvalei 195 IR near Delmas, Mpumalanga Province. Era Stene holds an existing mining right (MP30/5/1/2/3/2/1 135 MR) from the Department of Mineral Resources (DMR) since 2013 for their clay mining operations.

Jones & Wagener (Pty) Ltd Engineering and Environmental Consultants (J&W) has been appointed to assist with the application for an Environmental Authorisation for the proposed extension of the existing southern clay quarry. The Environmental Authorisation process is being undertaken in terms of the 2014 Environmental Impact Assessment (EIA) Regulations (GNR 982 – 985) promulgated under the National Environmental Management Act (NEMA, Act 107 of 1998). The application is being carried out in support of an amendment to the existing Mining Right in accordance with Section 102 of the Mineral and Petroleum Resources Development Act, (MPRDA, Act 28 of 2002).

The Environmental Impact Report (EIR) / Environmental Management Programme (EMPr) has been finalised and will be submitted to the competent authority namely, the DMR. The Final EIR/EMPr is also available for public review and comment at the Delmas Public Library (Tel: 013 665 1831, contact person is Ms Lydia Mehlape) from 21 February to 22 March 2017. You are also welcome to contact us for an electronic copy of the report which can be posted to you in CD format.


In terms of the National Environmental Management Act, Sub-regulation 56 (6), Interested and Affected Parties are required to submit their comments on the final reports directly to the case officer mentioned below. Please ensure that you include the reference number: MP 30/5/1/2/3/2/1 135 MR in your correspondence. Kindly send a copy of your comments to the public participation office.

The following are the next steps in the process:

  • The competent authority, DMR will review the Final EIR/EMPr;
  • Based on the competent authority’s findings, they will decide whether to grant or refuse Environmental Authorisation for the proposed project and will then issue their decision providing reasons for their decision;
  • Stakeholders will be notified of the competent authority’s decision within 12 days of receipt of receiving notification from the DMR;
  • Stakeholders will be infomed about the details of the appeal process. Any party may appeal the decision taken by the competent authority.
