The application for Environmental Authorisation (EA) for South32 SA Coal Holdings (Pty) Limited’s (South32 CSA) proposed extension of the Klipfontein opencast operations and associated partial closure and relocation of a section of the D253 road was approved by the Mpumalanga Department of Agriculture, Rural Development, Land and Environmental Affairs (MDARDLEA) on 5 September 2016, in terms of the Environmental Impact Assessment (EIA) Regulations, 2010 promulgated in terms of the National Environmental Management Act, 1998 (Act No.107 of 1998) as amended.

 Stakeholders were notified of the EA decision and its availability by means of notification letters sent on 6 September 2016 and newspaper advertisements placed in the Middelburg Observer (9 September 2016) and the Witbank News (15 September 2016).

 The EA document did however, contain a few discrepancies which the MDARDLEA has subsequently clarified and amended in order to align the authorisation with the Environmental Impact Report / Environmental Management Programme amendment (EIR/EMPR amendment) application. The MDARDLEA has provided an addendum to the original EA, including amendments and additions. This addendum document must at all times be read in conjunction with the original EA.

As per the EA, we would like to draw your attention to the National Appeal Amendment Regulations, 2015, which prescribe the appeal procedure to be followed. Should any party wish to appeal any aspect of the decision, an appeal must be lodged with the MEC of the MDARDLEA within 20 calendar days of the date of this notification.

 

The appeal submission must be submitted in writing in the form obtainable from the appeal administrator and be accompanied by:

•             A statement setting out the grounds for appeal;

•             Supporting documentation which is referred to in the appeal submission; and

•             A statement, including supporting documentation, by the appellant to confirm compliance with regulation 4(1) of the National Appeal Amendment Regulations, 2015.

The decision by the MDARDLEA was received by South32 CSA on 4 August 2017. The appeal must be submitted to MDARDLEA within 20 calendar days of publication of this notification.  Advertisements, notifying stakeholders of the amended Environmental Authorisation will be published in the Witbank News and Middelburg Observer on 17 and 18 August 2017 respectively.
